FOAJ Principles of Administrative Justice – Calgary

Principles of Administrative Justice is a two-day introductory or refresher course for administrative tribunal appointees, staff and advocates.  It is prepared and delivered by tribunal members.  This course is designed to provide participants with a better understanding of their broader role and responsibilities of tribunal members and tribunal processes. (14 Education Credits)

Workshop Objectives – After this seminar, participants will be able to:

  • Describe the focus of administrative law
  • Distinguish procedures from content of administrative  decisions
  • List the three basic elements of the duty to be fair
  • List the potential elements of the right to know the case and reply,  and be able to recognize and discuss potential issues in fact situations
  • Describe the test for bias in administrative law
  • Describe the purpose of “he/she who hears the case must decide it,” and identify potential issues

Workshop Outcomes – Participants will take away:

  • 3 key principles of fairness
  • tools to naturalize consistency in applying fairness
  • experience in analyzing scenarios to identify fairness requirements
  • basic understanding of evidence and tools for admitting evidence
  • awareness of a dependable process for decision making designed to reach a logical decision based on the legislation and facts
  • tips and tools to examine written decisions
  • confidence in their role
  • a self-learning plan.
